Upon approval of a State’s application which had to demonstrate that their State unemployment insurance law contained certain benefit eligibility criteria, the U.S. Department of Labor made the funding available for draw down based on formula distribution. To obtain the first 1/3 of funding the state law had to provide for either a base period that used recent wages or an alternative base period that used recent wages. Once the requirements for the first 1/3 of funding were met, then the remaining 2/3 of funding could be obtained if the state law contained 2 out of 4 options related to benefit eligibility. NYS has complied and received its share of funding.The State applied for and received approval from USDOL to use $20 million of the $412,742,107 for administration.

Funds must be obligated by the Federal Government by 10/1/2011. Once received by the States, there is no time limit on obligations. |
